Terms of Use

ACCEPTANCE OF TERMS: This website is made available in accordance with the terms set out below. To use this website, you must agree to these terms. If you do not agree to all of these terms, you should exit this website now and you may not use or access this website. Also by placing an order or contracting RAM Horn for web design, graphic design, illustration, and/or animation will be regarded as acceptance of these Terms and Conditions.

COPYRIGHT & PERMISSION: It is the sole responsibility of the CLIENT to obtain all necessary permissions and authorizations with regard to the use of all copy, graphic images, company logos, trademarks and or any other supplied material. Every contracted work will be seen as a guarantee that all such permissions have been obtained.

OWNERSHIP: All sites, graphics, and other files created by RAM Horn for the CLIENT are the sole property of RAM Horn until CLIENT'S balance is paid in full, at which time said sites, graphics, and other files are the sole property and responsibility of the CLIENT.

YOUR INFORMATION: RAM Horn is always aiming to improve services for its customers and the more RAM Horn knows about you, the better to serve you. The personal information that you provide to RAM Horn enables RAM Horn to personalize and improve your experience with RAM Horn and services for you. Your personal information is collected in a variety of ways such as completing your registration form. YOUR INFORMATION WILL NEVER BE SOLD OR GIVEN AWAY TO A THIRD PARTY OUTSIDE OF RAM HORN 'S SERVICES. USED FOR ANY OTHER MEANS THAN TO DETERMINE THE BEST OUTLINE AND SERVICE RAM HORN CAN PROVIDE FOR YOUR EXPERIENCE WITH RAM HORN’S SERVICES.

WEB ACCESS & RIGHTS: RAM Horn must be granted access to the server directory where the design is to be placed. By signing RAM Horn’s work contract, it is also granting RAM Horn full "on demand" access to the installed files. CLIENT further agrees that RAM Horn shall have the right to remove "our" design from public view for failure to adhere to the terms of this agreement. These could include violating licensing agreement or failure to pay fees duly assessed.

EXEMPTION: RAM Horn cannot and will not be held responsible for modifications, alterations, or deletions made by any third party. CLIENT acknowledges and agrees that RAM Horn has no control over and will not be liable for the unlawful acts of others who access CLIENT'S installed and publicly posted materials.

RIGHT OF REFUSAL: RAM Horn reserves the right to refuse service for any content deemed inappropriate, illegal or immoral. RAM Horn may cancel an agreement for failure of the CLIENT to abide by these terms.

SUBMISSION FOR REVIEW: RAM Horn will review with the CLIENT. This will allow the CLIENT an opportunity to review the appearance and content of the project. All custom content and graphics provided for CLIENT per the original contract will be considered as part of the finished product even if the CLIENT decides not to use. If the CLIENT request changes outside the limits of original contract, CLIENT agrees to pay RAM Horn design fees on a per hour basis. Unless RAM Horn is notified via email or by phone within ten (10) days of the review, RAM Horn will consider the material deemed acceptable by the CLIENT. Payment of the fee balance will then become due.

WEBSITE SERVICE INTERRUPTIONS: CLIENT acknowledges and agrees that RAM Horn cannot guarantee constant service because of the variables involved. Circumstances beyond our control include but are not limited to service interruptions caused by " acts of god ", telecommunications system failures and server problems.

LIABILITY: RAM Horn will not be held responsible for any damages arising from the use, misuse, or implementation of any sites, graphics, printed pieces, or other files created for the CLIENT.

DESIGNER "BRANDING": CLIENT agrees that a link to RAM Horn’s website will appear at the bottom of each page in the CLIENT'S site. Link will be in the form of a very small graphic and/or text link.

FEES: Fees due are payable by credit cards and via Pay Pal. The initial payment of 50% being due upon signing RAM Horn’s work contract. The balance will become due upon completion of the contracted work in accordance with the CLIENT'S original written specifications. Final payment must be received before web materials go "live" and before printed pieces, illustrations, and animations are handed over to the CLIENT or distributed. All overdue accounts will be assessed a 10% monthly late fee. All payments must be in US funds. PAYMENT MUST BE RECEIVED BEFORE WEB MATERIALS GO "LIVE" AND BEFORE PRINTED PIECES, ILLUSTRATIONS, AND ANIMATIONS ARE HANDED OVER TO THE CLIENT OR DISTRIBUTED. NO EXCEPTIONS.

WEBSITE COPYRIGHT: This website and all its contents, including but not limited to, text and graphics (collectively, "Content"), are all copyrighted, and the copyrights for this website are owned by RAM Horn Productions ("RAM Horn") or the creator of included content. You are, however, permitted to view, print and/or distribute Content in hard copy from this website provided that (1) you use such Content for your own personal or internal business use and not for any purposes contrary to RAM Horn's commercial interests; and (2) you do not copy or use any Content on any network or any other website for any public or commercial purpose; (3) you do not modify or alter any Content; and (4) you include RAM Horn's copyright notice on any such Content, as follows:
